HI. I just got an MIP in Clinton Township Michigan. I am on probation right now to Roseville for OWI and another MIP. What am I supposed to do? The cops in Clinton Township stopped my friend for swerving. I was in the front seat and the alcohol was in the back seat closed under his seat. I did not even know that the alcohol was in the car. Can I be found guilty if I had no idea it was there????? WTF????

Jimmy,
Thank you for visiting AllLegalMatters.com. We here at Canu Torrice Law have represented hundreds of clients at 41-B Clinton Township District Court in Michigan. As you are aware the MIP that you received could have a few impacts on your current probation in Roseville. You will probably receive a probation violation hearing in Roseville fairly quickly, which will need to be handled the right way.
If you had no knowledge that the alcohol was in the back seat and the police did not confirm that you had consumed alcohol you may have a great case. You need to contact our office at Canu Torrice Law immediately so that we can request all the in-car video to see exactly what happened on your case. You may possibly be able to argue that the police office stopped and searched the car illegally. Plus the fact that you did not know the alcohol was in the car may be a great defense.
If you wait too long the video may get destroyed or written over so it is imperative that they be requested immediately. Also, when you receive your probation violation we will have to move the court dates out far enough so that your Clinton Township court case can be handled correctly to avoid being found guilty of a probation violation. Strategy is the key in a case like this.
