I need a good Michigan drunk driving attorney right away, but I would like to ask a couple questions first. I am charged with drunk driving OWI in Eastpointe Michigan (Macomb County) and at my arraignment I was told it was a felony punishable by 5 years in prison and the State of Michigan is prosecuting me??? Are you kidding??? My last DUI in Michigan was almost 18 years ago, so isnt that off my record by now? I thought drunk driving offenses only stayed on your record in Michigan for like 5 years, and my friend told me if it’s over 10 years its only a misdemeanor not a felony because that’s what happened to him. I am freaking out because I cant go to prison I have a wife and 3 kids and a good job. I need a good drunk driving attorney for Eastpointe and some good advice. Ok, let’s clear up a few things first and then we will go from there. Drunk driving charges never are “off your record,” no matter how much time passes.
The law in Michigan regarding multiple drunk driving / DUI / OWI offenses changed several years ago. On January 3, 2007 Governor Jennifer Granholm signed into law new legislation that made any 3 drinking and driving related convictions within a person’s LIFETIME a 5 year felony. Under Michigan’s prior drunk driving law, a third offense DUI / OWI would be considered a 5 year felony only if the other offenses occured within a 10-year time period. With this new law change any Michigan driver arrested for drunk driving /DUI / OWI with two or more prior drinkng and driving related offenses at ANY point in time, regardless of their age, will face a 5 year felony charge. It is also important to remember that it doesn’t matter whether your prior charges were reduced to impaired driving / OWVI (Operating While Visibly Impaired), or whether they were straight up DUI / OWI convictions . . . the key is whether you have 2 or more prior drinkng and driving related offenses of any kind.
Your friend probably was prosecuted prior to the law change, ot he doesn’t know what he is talking about.
