Canadian caught Consuming Alcohol and Urinating in Public Misdemeanor charges Downtown Detroit Need Lawyer

ON Thurs Wednesday night (before thanksgiving) @ 1:55 am I was walking down an alley in downtown Detroit, aprrox. 1 block from greek town casino. This alley is right beside the Detroit Police Dept HQ. Parking lot.  It was a very Rainy night as well.

A police car rolled up behind me, and the female passenger asked me “what are you doing”

I didn’t answer, or just said, “going to greektown”.

She then asked “give me your ID”

I gave her my ID.

She then asked, “What’s that in your coat?”

So I handed her a beer that was in the inside pocket of my coat.

We had NO verbal conversation, whatsoever, other then that. (Should I have been informed I was under arrest?)

She wrote me out 2 tickets and then dumped the 1/2 beer out in the alley, she then attempted to give me back the empty bottle, but I declined the empty bottle and walked away. I believe I said “I don’t need that”.

Upon reviewing the tickets, I was given 1 ticket for urinating in public view. However, I do not believe that I was urinating as I was somewhat behind a dumpster, but I really don’t think I was actually urinating.  I believe I was walking and i stopped when she asked me “what  are you doing?”. It was very rainy, so I don’t know how they could have viewed me urinating from behind a dumpster.

My 2nd ticket was for CONSUMING alcohol in public view, however, I was not consuming the alcohol. It was in my inside pocket, and the officer asked me “what’s in your coat?”.

So if she asked for the beer, out of my pocket, then I couldn’t have been consuming it.

I have no criminal record, at all. I’m in my 30’s.

How can I get out of this with no record?  (expunged/deleted/like it never happened)

Over here in Ontario, this is just a ticket.

I know some people will pay a fine & go to a class what is that usually about? How many Classes?

Lastly, how or when would this actually “HIT” my record.

While camping my 20 year old son had his first seizure and fell into a bonfire. When he began to come out of it, he called 911 and told them he was burned and didn’t know how it happened. The ambulance and police went to the scene and he was the only person on site. He was not forthcoming with what happened and told the police that he didn’t think he was drinking and didn’t know what had happened. They gave him a breathalyzer and an MIP then took him to the hospital. Later that day he had another seizure and quit breathing. I gave him CPR and called an ambulance. The medical report states that he likely had 2 seizures that day as a side effect of his medicine. He had C-Diff (bacterial infection in the digestive system) and had been on 12 medication over a 2 week period. That night was the first he had gone anywhere for many days. My question is can we fight the MIP? How? They tell him its a $190.00 fine if he pleads guilty, but I read online that the Secretary of State adds points to a drivers license and imposes a fine for 2 years. Is this true? Thank you very much for any advice or suggestions.

So hi there all.. looking for advice, or possibly opinions on my case

 I am a 30 year old woman who is originally from Michigan, when I was 17 I got a number of tickets, and being young and dumb, I didnt take care of them. I moved to Phoenix Arizona and then on to minnesota for a few years. Two years ago I moved back to Michigan to take care of my old charges amoung other things. I had some traffic tickets, and two minor in possession (MIP) of alcohol tickets and one minor in posession of tobacco. (The cigarette and one alcohol ticket I got at the same time. )

Anyways I turned myself in and paid a bunch of fines, did a weekend of WAMM for the cigarette ticket, and got a year of non-reporting probation and fines for the alcohol ticket. These were both from the same judge.

My other alcohol ticket was heard by Judge Asadorian, she reamed me for letting them go for so long, understandable, but I did live accross country, I had a child, job, ect.. I couldnt just leave at any time to come here and deal with them. Anyways she gave me a year of probation, 250 hours of community service,  fines and ordered me to have my driver’s license back in two months, I had 800$ of tickets here, I also have 1200$ tickets in Phoenix, from one incident of being pulled over, non-dui, and 700$ in tickets from Minnesota from two seperate events, again no-dUi.

I paid all of michigans back, and I fell on bad times financially, I have no license, I had no way to get to community service, beside a boyfriend who took me sometimes, I completed 67 hours, then when we broke up, I was back to no transportation. I got  a violation, but heres the bad luck part, my mail was going to my dads house, and they are very unorganized there, they have three kids, who sometimes get the mail, whatever happened to it, I dont know, but I had no idea i had a violation hearing until I contacted my probation officer after not hearing from her for three months, and she told me I have a warrant now, with a 500$ bond.

I am in college currently, ( I ride share) am in custody battles with my kids father, who kidnapped her last year, which is the reason really I didnt do much, I was very depressed, and stressed, but now things are better, I have a cash job as a nanny for the girl I live with who is disabled, and I finally saved up 500$ to pay the bond. I am ready to turn myself in for the warrant, but I am SO scared that Asadorian will throw me in jail.

If that happens, I will lose my job, I will fail school, not to mention possibly my opprotunity to get financial aid in the future, and because I have an upcoming court date for my custody case, I may lose my daughter as well. I have no friends or family with money to help me. I only have my father as far as family goes, my mother killed herself years back after being on heroin my whole life…  I am very poor, and and its very hard to get enough money to be able to pay off my out of state tickets, buy a car and be able to get around to places to do community service.

I do not know what to expect. Do you think she will throw me in jail for this, as in giving me a contempt ? Do you think I could ask to just do the community service I didnt finish as jail time, say a week or so? I could manage that, but I couldnt do 30, 60, or 90 days, it would ruin my life, all over a ticket I got 13 years ago!!

Does anyone have some advice or input? I know I havent been the most repsonsible person, I am trying though, Ive had a tough life and have never gotten any other criminal charges anywhere.. the only reason I have so many tickets is because Ive gotten pulled over 4 times as an adult, and have been suspended since 17 years old.

please help if anyone knows what this judge is like. I would appreciate it.

Need Michigan Attorney for Case in 36th District Court in Detroit – Charged with Drunk Driving DUI OWI on Wayne State University (WSU) Campus and stopped by Wayne State University Detroit Police . . . can they arrest me for drunk driving?

I was arrested for Drunk Driving (or OWI /  DUI) on Wayne State University by WSU Police in Detroit and need an attorney to help with charges . . . can Wayne State Police really arrest someone for drunk driving?  Are they like Detroit Police, or like campus security?  I was drinking after class at the Circa bar, and drinks are really cheap there, got carried away and was pulled over by a Wayne State University cop who said I “rolled” a stop sign headed home to Grosse Pointe leaving campus towards Woodward.  The arrested me made me blow in a breathalyzer PBT and also at the Police station and they gace me this pink  ”Datamaster” ticket that has 2 different numbers .12 and .14.  This is my first ticket or anything and I am freaking out because I am on a scholarship at Wayne State and don’t want these WSU copstelling the University about my charge.  What’s going to happen to me?  Will Wayne State find out?  If they do wha will happen to my scholarship? ARE THESE GUYS EVEN REAL COPS?   Please help.   I saw a www.AllLegalMatters.com bumper sticker on campus once and it always stuck in my head as a catchy name . . . I see your attorneys do a lot of work at 36th District Court in Detroit on Offer to Engage cases and DUI drunk driving charges all over Michigan and I have read a lot of praise about you guys as the best driver’s license lawyers in Michigan so I am hoping I can be helped.

I found you guys on Google and took a chance with attorneys I never met and now I am happy I did.  Best attorneys in Michigan IMO! I had a traffic ticket in Fraser, Michigan for blowing a Red Light and even with a bad record these guys got me zero points.  Used another lawyer in December for another traffic ticket and he couldnt get my speeding ticket reduced in the Roseville court and 2 months later these guys get me a better deal with a worse driving record. Shows that its all who you know I guess, but these guys were awesome.

Need Michigan drunk driving OWI attorney in Eastpointe Michigan- 3rd Drunk Driving a 5 year felony in Michigan??? My last conviction was 18 years ago!!!

I need a good Michigan drunk driving attorney right away, but I would like to ask a couple questions first.  I am charged with drunk driving OWI in Eastpointe Michigan (Macomb County) and at my arraignment I was told it was a felony punishable by 5 years in prison and the State of Michigan is prosecuting me??? Are you kidding???  My last DUI in Michigan was almost 18 years ago, so isnt that off my record by now?  I thought drunk driving offenses only stayed on your record in Michigan for like 5 years, and my friend told me if it’s over 10 years its only a misdemeanor not a felony because that’s what happened to him.  I am freaking out because  I cant go to prison I have a wife and 3 kids and a good job.  I need a good drunk driving attorney for Eastpointe and some good advice.  Someone at court gave me your business card said you the best and I saw this website.  I need help guys, I’m afraid and that Judge seemed really tough too.

I’m busted, I admit it.  I was at a house party up visiting my buddy at U of M, we were all wasted and I was playing beer pong, Ann Arbor cops came.  I’m flat out busted. I’m on scholarship and cannot afford to have this shit go on my record. Michigan Family Law Divorce Attorney/Michigan Child Support/Michigan Spousal Support Question RE: Un-insured Medical Expenses With Ex-wife

Hi guys. Thanks for your answers on my past posts.  I need held from your Michigan divorce lawyer/family law/child support/spousal support team at CTZ Law. I was wondering how I should handle a situation with my ex-wife. We have been divorced in Michigan almost 10 years and any un-insured medical costs regarding my kids (co-pays, prescriptions, etc…) have been handled between ourselves. We each pay a percentage set by the Friend of the Court at 16th Judicial Macomb County Circuit Court. She recently submitted receipts for charges related to herself claiming the charges were for my kids. I looked at bills she sent me last year and found she did the same thing at least twice before. How should I handle this from now on since I don’t trust what she is submitting? Can everything now go through Friend of the Court since we didn’t do that at first? Can I go back and claim the fraudulent charges that I know of from last year? My child support is automatically handled through Friend of the Court in Macomb County Circuit Court. Thanks very much.

Recording Phone Calls in Michigan – Can I Record A Phone Call When I Am Talking To Someone?

I have a quick question regarding recording phone calls. I have heard in the past that laws vary state to state on if you need to inform the other party that you are recording the phone conversation or not. I’m curious what I need to do legally in Michigan. We have been getting harassed from a certain individual and before proceeding to further legal matters I would like to begin recording the phone conversations. Obviously the threat of recording may mitigate some of the harassment that we are getting, however I was under the impression that in Michigan I can record the phone conversation without their knowledge. Is that accurate or was I misinformed? Thank you in advance.

Used Car Question for Michigan Civil Law Attorney at CTZ Law

My parents purchased a Used car almost 90 days ago and have had nothing but problems. The salesman stated that the car was in good condition and my parents purchased an extended warranty. A week or so after driving it, it kept stalling – they have taken it in numerous times and spent alot of money out of pocket. Finally they had a full inspection done and the costs are well over $3,500. The insurance adjuster wouldn’t even drive the car because he said it was unsafe to drive and the dealership will do nothing to help. Is there anything legal we can do?

I was referred to this law firm by a friend. I had some problems with my drivers license and was getting nowhere fast with the Secretary of State (red tape city). But I heard from my friend about how these guys helped him, even though he thought he would never get his license back, because of the thousands of dollars the state of Michigan was trying to get from him for “driver responsibility fees.” These attorneys cut through the red tape and got him his Michigan driver’s license back! My Michigan license is suspended because I owe thousands of dollars in driver’s responsibility fees for traffic tickets, speeding tickets, no proof of insurance tickets and a driving while license suspended charges here in Michigan that I got because my Michigan driver’s license was suspened for all my unpaid fees, which is another $1000.00 more now because I got another DWLS charge!!!!

Is there any way I can get out of paying this?  I am thinking about filing bankruptcy anyway with Michigan’s job market sucking so bad that I can’t even get a job at a Wall Mart and if I do this and file Chapter 7 bankrupcy here in Michigan will it wipe out the driving responisbility fees I owe to the state of Michigan secretary of state??  This may be a way to kill 2 birds with 1 stone if you know what I mean so I can drive again and get rid of all this debt.

Michigan criminal expungement lawyer question: How do I expunge my criminal record or set aside a criminal conviction in Michigan?

Dear www.AllLegalMatters.com Michigan criminal expungement attorneys:

About 4 years ago I was convicted in 16th Circuit Court Macomb County Circuit Court in Mt. Clemens, Michigan for Delivery and Manufacture of Marijuana because I was growing pot in my basement.  I ended up pleading guilty with my court appointed lawyer (I know it was stupid but I had no money to hire a good criminal defense attorney like from your law firm), and finished probation and everything no problem.  My lawyer at the time told me when probation was over I could have the court set aside or expunge my conviction for this drug crime in Michigan. 

Is that true?  Should I hire a lawyer or can you tell me how to expunge my criminal record in Michigan?  What are the rules to set aside and expunge my criminal record in Michigan?  Can one of your Michigan attorneys set aside my criminal conviction and clear my record for this weed case in Macomb County for sure?  I have already been turned down for some jobs and I know its because I have a record because a lot of employers to background checks now.

Dear Michigan Driver’s License Lawyer at CTZ Law:

I have had some suspended licenses in Michigan over the past 2 years for unpaid speeding tickets but I always paid them just sometimes late and when I was pulled over a couple times my Michigan license was suspended for not paying my traffic tickets.

I just got another DWLS because I have an unpaid speeding ticket in Sterling Heights, Michgan. I know I need an attorney because last time i went without a lawyer for a DWLS charge the judge in Rochester Hills almost threw me in jail and I had all types of probation. My question is the more DWLS charges I get on my michgan driver’s license will that mean the secretary of state will suspend my license longer?

Thanks for your help. I just need my Michigan license to driver to school at Macomb Community College and my job, and I need an attorney to help me!

Got a suspended driver’s license in Michigan and I need a driver’s license attorney to help me get my driver’s license back; 2 drunk driving convictions in Macomb County.

I need the best driver’s license lawyer in Michgan to help me, and you guys seem like you are themost knowledgeable drivers license lawyers in Michigan. I was convicted for drunk driving in Roseville Michigan about 4 -5 years ago and I recently got another drunk driving in Fraser Michigan (same court, 39th Judicial District Court). I am almost more concerned about my driver’s license than going to jail even though I know I may go to jail. My queston is … is it true that no matter what happens, if I get convicted of drunk driving/OWI or even impaired driving, the State of Michigan Secretary of State will take away my Michigan driver’s license privledges for 1 whole year! Need A Driver’s License Lawyer’s Advice – How Do I Get My Driver’s License Back In Michigan After 3 Drunk Driving Convictions – I Have Revoked Suspended Michigan Driver’s License And Need Attorney?

I had a bad spell of luck the last several years here in Michigan.  I went through a terrible divorce, lost my job, my parents died and everything in my life fell apart.  I started drinking a lot and had 3 drunk drivings all 2 in Macomb County and 1 in Oakland County Michigan.  I had a lawyer for each case, court appointed for the last one because I was broke, and my Michigan driver’s license is gone now.   I did jail time and it will be a few years before I can even appeal to have my Michigan driver’s license re-instated.

My question is that I do not even understand what is going on with my Michigan driver’s license.   I called another Michigan driver’s license lawyer off some random internet website, it took forever for them to call me back, and they didn’t seem to know what the hell they were even talking about because they didn’t make any sense.  After reading all the posts on here about Michigan drive’s license appeals it seems like you guys are the best driver’s license attorneys in Michigan for someone like me who has some major driver’s license problems.  All I want to know is how driver’s license suspensions and revocations in Michigan work and what the process and law is to get it back.  I know it’s a lot to explain so I will call you guys if you want.

I have a question for one of your Michigan attorneys for a drunk driving case in Shelby Township, Michigan. A few weeks ago, a friend of mine was arrested for drunk driving in Shelby Township. Although he was drunk, the Shelby Township cops had no reason to pull him over. He was not speeding, he used his turn signals, and he stopped at all stop signs. Is it still legal for police to pull him over even if he did nothing wrong? Once Shelby Township police did pull him over, he blew in the PBT breathalyzer but they point is they had no reason to pull him over to begin with. What can be done? Is an illegal stop a basis to have his case thrown out completely? Can one of your Michigan criminal defense drunk driving lawyers help?

I need a good St. Clair Shores criminal defense attorney for a drunk driving charge I recently received my first drunk driving in Michigan while leaving a Halloween party with my friends in St. Clair Shores. As a current law student, what can be done to ensure that this drunk driving charge stays off my record? Also, will I have to report this offense to Michigan’s Character and Fitness upon my completion of the J.D. program?

I want to thank Paul Zalewski for the quick response to my other question about Michigan’s Minimum Wage Law and he is right on! Thanks for the advice and it has already helped!!!

I have another question though: I am wondering if I have any claim to personal property left behind at my ex-wife’s house. We separated in late 2000 and the divorce was final in September, 2001. In out settlement agreement there was no specific personal property mentioned as to who gets what. We had both agreed to the division of personal property and I thought I got everything I had there. Recently my kids found a collection of sports trading cards which I forgot about. I’m wondering if I have any legal rights to ask for them back? The cards were not specifically mentioned in our divorce settlement.

Michigan Drivers License Lawyer Advice Needed For Driving While Drivers License Susended in 36th District Court Detroit Wayne County Michigan – Will I Get An Additional Suspension on Michigan Driver’s License?

I was pulled over by a Wayne County Sheriff coming back from Detroit Lions game. I wasn’t drunk driving or anything (although I should have been drunk because the Lions SUCK), but my Michigan license was suspended because I forgot to pay a traffic ticket for running a red light in Troy.

Will this charge result in some sort of additional suspension of my Michigan driver’s license even if I go pay that ticket in Troy tomorrow? What are the consequences against my Michigan drivers license for getting this driving with a suspensed license charge in Detroit? Desperately need driver’s license lawyers advice.

Credit Options! Legal question to attorney about Michigan debt negotiation, credit card debt, and possible bankruptcy.

Hello, I am wondering what my options are!

I work as an outside sales rep, servicing the Michigan manufacturing industry. Paid a base pay with commissions. Work has lowered my base by 20% and due to the economy my commissions are down 35%. My year to date is down about 55% right now. Struggling to pay bills, I have depleted my savings and have let one of my credit cards go into collections. Up to date on the rest of my bills just no cash left over week to week. One of my credit cards was sent to collections for about $4500. Cant come up with the money to settle and scared i am in a death spiral and cant find a way out. Stress just to keep the bills paid and food on the table is just to much. I know you probably see much larger credit debt, but to me at this time it may as well be $1,000,000.00. Can you give some advice?
