February 28th, 2010 1 comment

I hope this article can serve to answer a lot of the post questions below to our Michigan attorneys and our driver’s license legal team about suspended and revoked driver’s license issues.  At Canu, Torrice & Zalewski, PLLC / www.AllLegalMatters.com we get a lot of calls from clients looking for a driver’s license attorney to help with their suspended or revoked Michigan driver’s license legal problems.    I have also noticed that this topic gets a lot of attention on CTZ Law’s free legal blog here.  That’s because the Michigan driver’s license attorneys lawyers at CTZ Law are among the most experienced and qualified driver’s license attorneys in the State of Michigan. The CTZ Law driver’s license attorneys have dedicated a large portion of their practice to driver’s license appeals and restoration cases, and as a result our Michigan driver’s license attorneys have helped countless Michigan drivers get their driving privileges restored.

If your Michigan driver’s license is suspended, restricted or revoked due to multiple drunk driving offenses, Implied Consent violations (refusal of a breathalyzer test), too many points from traffic tickets, Drug Crime convictions, or any other driving related legal problems, the driver’s license attorneys at CTZ Law help you today!

Your Michigan driver’s license is a privilege, not a right, and the Michigan Secretary of State establishes the laws that govern your Michigan driving privileges. Protecting your privilege to drive in Michigan is extremely important because Michigan is predominantly a commuter state, meaning that there is no effective means of mass transportation in Michigan, like subways or trains, that can effectively get you to and from work or school if you do not have a valid Michigan driver’s license.

What Causes Your Michigan Driver’s License To Be Revoked or Suspended and Why You Need a CTZ Law Attorney?

There are numerous ways your Michigan driver’s license, also known as your “Operator’s License,” and your Michigan driving privileges can be restricted, revoked or suspended due to traffic and criminal convictions. Under any of these circumstances you should contact CTZ Law for a free consultation and ask to speak with one of our expert Michigan driver’s license lawyers. A restriction, revocation or suspension of your Michigan driver’s license may result from having too many civil infractions or traffic tickets on your driving record, or from being convicted of certain criminal offenses (such as multiple drunk driving/OWI convictions, or driving while license suspended/DWLS charges), as well as for other offenses such as your refusal to blow in a breathalyzer machine upon your arrest for drunk driving under Michigan’s “Implied Consent” law.

Under Michigan law, your driver’s license may be suspended or revoked if you are have too many “points” on your master driving record maintained by the Michigan Secretary of State from convictions for moving violations, such as speeding, disobeying a traffic control device (like running a stop sign or red light), improper turn, traffic accidents, and careless driving.

Your driving privileges may also be suspended or revoked for certain criminal offenses, such as drunk driving (OWI/OUIL/OUI/DUI) convictions, driving while your license is suspended, restricted or revoked (DWLS/DWLR), driving without a driver’s license, leaving the scene of a personal injury or property damage accident (hit & run), drug crimes such as possession of cocaine, heroin, or marijuana, and other offenses such as drag racing, vehicular manslaughter, and other criminal convictions.

Also, under Michigan’s “Implied Consent” law, all drivers with a Michigan driver’s license automatically consent to be given a breathalyzer test at a police station (on a “Data Master” machine) upon the lawful request of a police officer who has probable cause to believe you were drunk driving. Your failure or refusal to consent to be given this breathalyzer test for blood alcohol levels will result in six (6) points being added to your master driving record with the Michigan Secretary of State, and your driver’s license will automatically be suspended for a period of one (1) year.

The Legal Process of Restoring You Michigan Driver’s License with CTZ Law’s Driver’s License Legal Team.

Driver’s license restoration in Michigan generally takes two (2) forms. In the first case, a Michigan driver who has lost their license can challenge the suspension or revocation by filing an action in the Circuit Court in the county where they reside. In these situations, a Michigan Circuit Court Judge has the authority to decide whether to deny their request, fully restore their license, or reinstate their license with restricted driving privileges. In the second situation (where most Michigan driver’s license restoration cases fall), a Michigan driver appeals the revocation of their driver’s license (hopefully with the assitance of a Michigan driver’s license attorney at CTZ Law) by petitioning the Michigan Secretary of State Drivers’ Assessment and Appeal Division (“DAAD,” formerly known as “DLAD”) and by appearing before an Administrative Law Judge with legal justification for having their license restored. This DAAD/DLAD hearing is your chance to contest the revocation of your driver’s license, and to persuade the Administrative Law Judge to reinstate your Michigan driving privileges. Proper legal representation in all driver’s license cases is required because the Michigan Secretary of State establishes extremely strict guidelines to determine whether a suspended driver is eligible to apply for an appeal, and it is often limited to only one appeal per year. In many drunk driving cases, an appeal cannot be filed for at least 1 to 5 year after the date of conviction. Fact: the vast majority of people who try to appeal the suspension or revocation of their driver’s license without a trained Michigan driver’s license lawyer lose the appeal. If you try to appeal yourself and you lose, then you generally have to wait another year before you are eligible to petition the Michigan Secretary of State for another hearing, and your chances of getting your driver’s license back decrease substantially.

Obtaining a qualified and experienced driver’s license attorney to restore your driving privileges is essential to get back on the road. At CTZ Law, our driver’s license lawyers are experts in getting Michigan drivers back on the road again. Our success rate is unparalleled, and our driver’s license attorneys are the most qualified in the state of Michigan. However, the process of restoring your driver’s license is involved and complicated, and it is important to present the most compelling case at your hearing possible. Unprepared or ill prepared cases will result in the Judge denying your request and another year must pass before the process for restoration can begin again. Representation by competent counsel is critical to the success of license restoration.

Your first step towards restoring your driver’s license is to call the Michigan driver’s license attorneys at CTZ Law immediately! We will review your master driving record and provide a comprehensive assessment of your case. By planning and presenting a fully prepared case at your hearing, with the help of CTZ Law, you will be back on the road again.

Looking for Michigan Civil Business Collection Attorney Lawyer or Law Firm to Sue Company That Owes My Corporation Money on Unpaid Invoices – Want to File Lawsuit

February 28th, 2010 1 comment

I give you guys credit.  When Michigan business owners say such good things about their civil collection attorneys that says a lot about the lawyers at your law firm.  Let me tell you its tough to get paid in Michigan especially in manufacturing business and you need a good attorney to lawyer-it-up sometimes to get these big companies to pay their invoices and bills.

I see you are a local Macomb county law firm in Fraser Michigan that does civil collection work I hope you can help or give me some advice.  I am the plant manager at a local Tier 1 / 2 manufacturing company in Roseville Michigan, and like everyone else with the Big 3′s problems and loss of work we are down to a skeleton crew of employees and a struggling to survive.  It doesn’t help when some larger companies we still do work for don’t pay their bills.   We have used larger law firms  in Michigan in the past to do collection work and lawsuits but my owner is done with paying $350 an hour for some big firm to over bill and under produce.  By the time we get done paying them attorney fees and settle we break even at best and waste a year fighting in court. It’s not worth it to sue sometimes.

I need a Michigan attorney or law firm to help collect money from company that owes my manufacturing business $8000 in unpaid invoices.  This company is 120 days past due on their account and has made no effort to pay their invoices.    Can one of your Michigan civil attorneys help collect on this unpaid bill and get this corporation to pay their invoices in a cost-efficient manner?  Is their any way for us to sue on our own outside of small claims because we can only get $3000 max there I have found out from experience.  We want our money and we are willing to take some kind of settlement but not less than 50 cents on the dollar which small claims would force us to do.  We are not afraid to sue but when you get a $9000 legal bill from a law firm on a $8000 claim its obviously not worth it.

Need Michigan Attorney for Case in 36th District Court in Detroit – Charged with Drunk Driving DUI OWI on Wayne State University (WSU) Campus and stopped by Wayne State University Detroit Police . . . can they arrest me for drunk driving?

February 21st, 2010 5 comments

I was arrested for Drunk Driving (or OWI /  DUI) on Wayne State University by WSU Police in Detroit and need an attorney to help with charges . . . can Wayne State Police really arrest someone for drunk driving?  Are they like Detroit Police, or like campus security?  I was drinking after class at the Circa bar, and drinks are really cheap there, got carried away and was pulled over by a Wayne State University cop who said I “rolled” a stop sign headed home to Grosse Pointe leaving campus towards Woodward.  The arrested me made me blow in a breathalyzer PBT and also at the Police station and they gace me this pink  ”Datamaster” ticket that has 2 different numbers .12 and .14.  This is my first ticket or anything and I am freaking out because I am on a scholarship at Wayne State and don’t want these WSU copstelling the University about my charge.  What’s going to happen to me?  Will Wayne State find out?  If they do wha will happen to my scholarship? ARE THESE GUYS EVEN REAL COPS?   Please help.   I saw a www.AllLegalMatters.com bumper sticker on campus once and it always stuck in my head as a catchy name . . . I see your attorneys do a lot of work at 36th District Court in Detroit on Offer to Engage cases and DUI drunk driving charges all over Michigan and I have read a lot of praise about you guys as the best driver’s license lawyers in Michigan so I am hoping I can be helped.

I will be in class all day tomorrow but please respond ASAP because I have a court date coming up soon.

Thanks.

CTZ LAW MICHIGAN ATTORNEYS ARE THE BEST LAWYERS FOR TRAFFIC TICKETS IN FRASER MICHIGAN!!!!

February 17th, 2010 1 comment

I found you guys on Google and took a chance with attorneys I never met and now I am happy I did.  Best attorneys in Michigan IMO! I had a traffic ticket in Fraser, Michigan for blowing a Red Light and even with a bad record these guys got me zero points.  Used another lawyer in December for another traffic ticket and he couldnt get my speeding ticket reduced in the Roseville court and 2 months later these guys get me a better deal with a worse driving record. Shows that its all who you know I guess, but these guys were awesome.

Thank you CTZ LAW!

Need Michigan drunk driving OWI attorney in Eastpointe Michigan- 3rd Drunk Driving a 5 year felony in Michigan??? My last conviction was 18 years ago!!!

February 16th, 2010 2 comments

I need a good Michigan drunk driving attorney right away, but I would like to ask a couple questions first.  I am charged with drunk driving OWI in Eastpointe Michigan (Macomb County) and at my arraignment I was told it was a felony punishable by 5 years in prison and the State of Michigan is prosecuting me??? Are you kidding???  My last DUI in Michigan was almost 18 years ago, so isnt that off my record by now?  I thought drunk driving offenses only stayed on your record in Michigan for like 5 years, and my friend told me if it’s over 10 years its only a misdemeanor not a felony because that’s what happened to him.  I am freaking out because  I cant go to prison I have a wife and 3 kids and a good job.  I need a good drunk driving attorney for Eastpointe and some good advice.  Someone at court gave me your business card said you the best and I saw this website.  I need help guys, I’m afraid and that Judge seemed really tough too.
